PURPOSE
These General Terms and Conditions of Sale govern the rights and obligations of the parties in the context of online sales on the website cannabisking.ch.
PURCHASE
General principle
Any purchase of an item on the cannabisking.ch website implies the Buyer's acceptance of these General Terms and Conditions of Sale.
The General Terms and Conditions of Sale are accessible on the cannabisking.ch website, as well as during order confirmation. The Buyer may consult the General Terms and Conditions of Sale before clicking on the checkbox entitled I have read the General Terms and Conditions of Sale and accept them without reservation.
Confirmation and conclusion of contract
All successfully completed purchases are subject to a confirmation message to the Buyer and an order confirmation e-mail.
The sales contract is deemed concluded at the time of order confirmation by the Vendor, which occurs after validation of the order and receipt of the sales price. In all cases, the sales price is due and payable upon conclusion of the contract, i.e. upon confirmation of the order by the Vendor. The seller may withhold delivery until payment has been received. Exceptionally, the seller may, without waiving these terms and conditions, authorize deferred payment.
By placing an order, the Buyer declares that he/she has full civil rights.
Buyer's obligations
The Buyer undertakes to provide valid contact details when placing the order and to pay the price requested.
The Seller assumes no responsibility for the fact that goods ordered cannot be delivered due to lack of available stock, additional supplies, production or customs seizure.
The Seller remains free to discontinue or modify the products offered, at its sole discretion and at any time.
PRICES
Prices in this catalog are guaranteed net, including VAT, and are quoted in Swiss francs.
Prices do not include shipping costs, which are invoiced in addition and vary according to the weight and size of the package.
Discount coupons are not cumulative.
Shipping costs for deliveries within Switzerland are indicated in the order summary.
Once an order has been confirmed, its price cannot be modified.
Items covered by a warranty are subject to the conditions of the offer valid at the time of purchase. The warranty takes effect on the date of delivery of the item, as evidenced by the accompanying document (invoice), which we ask you to keep carefully. Damage due to improper maintenance, failure to follow instructions or normal wear and tear is not covered.
Subject to the foregoing, the Seller is authorized to modify, at its sole discretion and at any time, the price of the goods offered.
PRODUCT SHIPMENT AND DELIVERY TIMES
Available items are dispatched by post within 1 to 3 working days of receipt of full payment for the order, except in special cases. A contribution from you may be requested once per order.
From September 1, 2024, cannabisking.ch will only deliver in Switzerland. If you wish to buy in the Euro zone, you can go to our website cannabisking.fr.
IMPORTANT: Cannabis King® does not deliver to P.O. Boxes and does not deliver to minors or persons under guardianship without written authorization from the parents or guardian.
The transfer of risk - which includes the risk of loss as well as deterioration of the merchandise - passes to the Buyer upon confirmation of the order by the Vendor.
In the case of incorrectly addressed or unclaimed parcels returned to us for reshipment a 2nd time, a flat-rate charge of CHF 20.00 will be invoiced, including the cost of the 2nd shipment and related administrative costs.
RETURN OR EXCHANGE OF GOODS
Items must be returned undamaged and complete in their original packaging (with reference labels), accompanied by the delivery note, within 7 days of receipt of your parcel, as evidenced by the date of the postmark. Opened or damaged packages will not be accepted. You are responsible for return postage costs. In the case of an exchange order, the shipping costs for your new order are free.
PAYMENT
Payment methods : Visa, Mastercard, Twint, PostFinance (card), E-Finance (account), Bank transfer, Bitcoin, Payment on receipt, Payment on invoice.
PAYMENT ON INVOICE within 30 days in partnership with swissbilling.
swissbilling SA is a service that enables you to pay for your order by invoice, simply and securely.
The invoice will be sent to you by swissbilling separately from the parcel, by e-mail or by post, depending on your choice. Swissbilling services entail additional billing costs. The maximum amount for a first purchase with swissbilling is CHF 300.00.. Payment must be made within 30 days of receipt of the invoice. For security reasons, the billing address and delivery address must be identical. Before accepting your order, swissbilling AG reserves the right to check your creditworthiness with the CRIF AG database in Zurich (Tel.: 0848 333 222, www.crif.ch).
GUARANTEE
The condition of the goods delivered must be checked within 2 working days of receipt to exclude obvious material and manufacturing defects, as well as transport damage. In accordance with the law, you are obliged to notify us of any defects or anomalies affecting the goods delivered, to enable us to remedy them.
In the case of vacuum-packed goods, the Buyer must check that the complete order is present BEFORE unsealing the transparent packaging. He/she must photograph the intact goods and send us the photograph(s) by e-mail. Complaints concerning open packaging will not be considered.
Photos of items on cannabisking.ch are not contractually binding.
DATA PROTECTION
We guarantee compliance with the provisions of the Swiss Data Protection Act and the relevant legal standards for the collection, processing and use of personal data.
Data collected during the order process will be used for internal purposes only. The customer accepts this use of his/her data with the order process. In addition, he/she always has the right to request information on the data saved and may prohibit their use for internal marketing purposes.
To exercise these rights, the user should contact Customer Service at info@cannabisking.ch, providing proof of identity in the form of a copy of a form of identification.
MODIFICATION OF GENERAL TERMS AND CONDITIONS OF SALE
The Vendor may amend these General Terms and Conditions of Sale from time to time. The version in force at the time of the order shall prevail in the contractual relationship between the Buyer and the Seller.
APPLICABLE LAW AND JURISDICTION
In the event of a dispute, the General Terms and Conditions of Sale in force at the time of purchase shall be used as the legal basis.
The applicable law is Swiss law and any dispute will be handled by the Geneva Court.
